What if someone gets tired of waiting before approval and wants to cancel and get money back? What is the process?

Money back from the govt? Are you mad??

Actually it is in the rules.

    4.

Withdrawal of Application. The application may be withdrawn prior to approval by submission of a written request from the maker. The NFA Branch will arrange for a refund of any tax paid.

    5. Cancellation of Approved Application. An approved application may be cancelled only if the firearms had not been made or modified. The maker must return the approved application with a written request for cancellation, citing the need and that the making of the firearm did not take place. The NFA Branch will arrange for a refund of any tax paid.

This applies to a Form 1. Cancelling a Form 4 would involve the retailer selling the item who may charge fees.

This is a response from a lawyer in the field.

How do I stop or cancel a Form 1 or Form 4 that has not been approved by the BATFE?

I finally called today to check on the status of my transfer, which I’m sure they love right now, and all he would say was that it was received May 25th, and it’s pending. I guess we’ll see what happens in the next month, who knows?

My forn 4 went in late April and I’ve heard nothing. Plus the month missed does’t help.

I put mine in Feb18, check was cashed 26Mar18, FBI BGC is still pending… I did read that the FBI was doing BGC’s during the shutdown so that’s good. Still holding my breath though for this unconstitutional garbage.

I’d bet they all went to different examiner’s.

Looking at the last 30 days of transfers on the tracker it doesn’t look like a single Form 4 has been approved. It’s all Form 1. I realize the majority of that was government shutdown but the fact that there haven’t been any SINCE the government shutdown is a bit depressing.

That’s great to hear! That makes me happy that they are processing, but very sad that it took you 11 months.

Some state reps have a “help me with a federal agency” link on their website. Or they have contact info on their websites. Just google, who is my state rep, and many sites will lead you in the right direction.

I called today and was given the standard response, “your application was received 5/23 and is pending.” she was not friendly either lol.

I think I know who your talking about. I called in early December and was told pending, I asked if I’m stuck in the FBI BG and she still said pending, I then asked for a time frame and still said pending. She’s like a damn robot!

Check cashed 6/4/18. Guess I shouldn’t even bother looking lol.

    Whole process is ridiculous.

Pretty much how I feel hearing that the wait time is up to, and in excess of, 10 months. Not to mention another government shutdown is looming.

My check was cashed on 6-28-18, I called in December. The lady at ATF said they were running at 7 mo. With the shutdown I would think it would be late this month, Feb or early March. I’m to impatient for the speed at which this process takes.

Emailed the Senator but being a democrat I doubt if much will be accomplished and a privacy statement needs to be completed and mailed. Kind of an ironic thing they can do a background check, but to check on the status of it you need to give them permission.

I’ve never seen an operation so inefficient. Why they can’t establish accounts for those submitting so subsequent applications can be tracked and go back to the same people. Or added applications go to those pending. But it seems every application starts as a new process.

A while back the Boston ATF office sent some people to one of the local gun shows. A really pleasant group of people who seemed like they really wanted to process to go smoothly. but I guess they don’t have the ability to actually change anything.

What happens when you are awaiting approval and the dealer who has your items is not renewing their license?

I had a similar thing happen. My dealer sold his business but went ahead and did the paperwork for all those that were still waiting as our tax stamps came in. He did them out of his house instead of his former business. You might just check with the dealer and see what he says.

Feedback from ATF is a little confusing, one person says that pending means its sitting on someones desk,
another tells me it at the FBI, the suppressor has been disposed to the dealer, so can anyone give a little insight? Check was cashed 6/4/2018, can was sent to dealer 6/10/18, getting the run around from these asshats seems to be their priority.

Check cashed 2-21-2018. First time applying for an NFA item. Form 4 trust. I called first time in August 2018 and was told that it was awaiting FBI background check. Called last Monday 2-11-19 and told the same thing. I have called several times in between. During the shut down( yes my call was answered) I was told the examiners were out for the shutdown but, I needed to talk to one to see what the hold up was. Now after the shutdown has ended and they are back to work, I am told that I cannot talk to the examiner and the FBI hasnt given any information back on my background yet. I think that the NFA needs to get their crap together and get people to answer the phone that are a little happier to be employed with them.

    Ready For Pickup – 2/9/19

I’m not sure when I was approved, but I just checked my voicemail today (2/19) and there was a message from my FFL from 2/9 that I was ready for pickup. Going today after work. Need to listen to my voicemails more often!

Is there any easier way of checking the status of form 1/4’s other than having to call the ATF?
