    Form 4 – paper – individual… 360 days and counting. Seems like I’m on the high end of the timeline and graphs. Does anyone have any good information? Seems like there is no light at the end of this tunnel.

      whynot – Due to the government shutdown, only Forms 3 & 5 are being processed right now. Nothing is happening on Forms 1 & 4 until the government reopens. Sorry, but we’re all stuck right now.

        K3B, understood. Still only been 3 weeks of shutdown though. That would still leave me on the high end of things. I wasn’t expecting anything to come through right now for sure.

        K3B, can you tell us where you got that information? Others on this forum have called and been told that the examiners are working as “essential” employees. And what are forms 3 and 5? So far as I can see, there are only forms 1 and 4.

          Okay so I’m replying to my own inquiry. I just called the ATF and talked with a very nice guy (Justin). He said ALL examiners are furloughed during the shutdown. Bummer. Just thought I’d pass on the bad news.

          Form 3 is dealer to dealer. A Form 5 is used to transfer from an estate to beneficiary ($5) in the event of death of owner.

          FYI, if you don’t have a will, your NFA items are surrendered.

    Form 5 is also used to transfer to Govt Entities. Those would be what they are most likely working on, not the estate transfers.

    So, I may be way off here but… At what point does the shutdown become a constitutional issue? (Not that the NFA isn’t anyway!)

    If the shutdown goes on for months/years doesn’t that mean the government is infringing on our rights? If they can’t flat out ban these things and the process set up isn’t being funded, that’s pretty much a backdoor ban.

    Y’all see any merit to this line of thinking?

      At one point at the turn of the Century there was a marijuana stamp, you could buy at the Post Office. When Congress banned the substance, the stamps continued – I don’t remember the specific case, but SCOTUS ruled that the presence of a stamp does not override Congress’ ability to regulate and ban.

        What does being able to buy marijuana stamps after a ban was implemented have to do with their question about whether the indefinite government shutdown is an infringement itself?

        If the BATFE/FBI aren’t being funded, the shutdown is completely preventing the acquisition of all NFA related items during this period, essentially an outright ban on purchasing.

    Well, still waiting after my Nov 15 approval.

    Called on the Dec 18th, was told to submit a letter requesting a certified copy. Letter sent on Dec 19. Will update when it comes in.

    Still nothing at the dealer, they said they’d only mail the certified copy to me, the transferee. Will see how long this takes, and update when/if it comes through.

    And finally. Received the certified copy on 1/8/19, postmarked 1/4/19. Not sure if I’ll ever get the actual stamp (hope so, because seriously. I’m a stamp collecter, dagnabbit). Dealer was surprised I received the certified copy, but gladly made a copy of it (for their records, I guess?) 4473 to move it off his books to me and now I’ve got my slick new GM-45. Can’t wait to get it out in the woods. Good luck everyone, hopefully Washington can get on the ball and Congress can get back to work.

      Did you have some special circumstances involved or why was it delayed so long? It sounds like they lost it and once nudged by the congressman they searched and found it.

        i think thats what happened, lost in the shuffle. i would call and call and call and all i would get is that its in background check, ATF wasn’t any help. FBI wouldn’t talk to me at all when i would try and call them.

      Kenny- my form 4 has been in for 12 months. In fbi background check for 7 months. How Do I go about contacting my congressman and how does that work? Do I write him a letter or an email? And what should it say?

    I think I forgot to post my outcome here. I mailed my Form 4 in July 9th, they charged my card the 13th, I was approved November 29th, and had my stamp and my suppressor in hand around Christmas due to a mailing delay.

    Much quicker than I could have hoped for, I was expecting to wait until spring. I like this outcome better.

      Rick, I am very surprised to see you only wait under 5 months to get your Form 4 approved, I haven’t even seen anyone get approved at 6 months.

    I had 3 all submitted same day and approved in less than 6 mos. 175 days but still under 6 mos.

    I just read that the leader of the American empire will sign a bill that opens the govt back up for a short time, how long is anyone’s guess.

      1/20/18 check cash date here. So 375 days. Form 4 Trust. My fourth suppressor, the others were about 8-9 months’ turnaround.

      Called in early December, was told my application was in the background check phase.

    I emailed S.S. and asked if the FBI bgc was still active during the shut down. that said that it WAS up n running. So hopefully that will ease some of the background check blackhole.

    I have a purchase date of 3/27/18 and check cashed date of 5/2/18 for a SiCo Omega 300. I’m sure some have been waiting longer, but I recently contacted my districts congressman in GA for help with this. This is the response sent back from the ATF this week FYI (similar to what some have posted before but with more detail regarding the shutdown):

    “Prior to the shutdown the processing time for ATF Form 4, was 7 months, however; at this time ATF is experiencing over a 125,000 backlog and therefore the processing time is expected to be in excess of 10 months.

    ATF has and will expeditiously continue to process these applications to reduce any existing backlog. An unperfected ATF Form 4 that needs corrections will take longer than 10 months to process. In fiscal year 2007, ATF processed nearly 66,736 NFA applications. In 2016, ATF received more than 379,410 applications, in 2017 ATF received 386,210 applications, and in 2018 ATF received 339,278 applications.

    Applications are still under agency review. If you have any questions please let me know.“

    So I purchased a suppressor on November 15 2017.They cashed the check on December 12, 2017. As of today when I called, they are still waiting on the FBI background check to come back. This totals to 422 days and counting since the check was cashed. I don’t even think the NFA Tracker chart goes that high currently. I have written a letter to my state representative, but haven’t heard back from him yet. My Last two tax stamps came back in about less than 6 months. Of course this was back in 2015. And it was with a trust rather than individual form 4. But I have no criminal record. I have never been denied to purchase a firearm, although I get a delay about half the time. I also passed a background check to get a state CCP. My patience is wearing pretty thin, although I can think of nothing else to do but wait…

      Matt. i have very similar situation, purchased in October of 2017, cashed in January 2018, finally got response from my senator yesterday after nearly 3 month wait and sent my consent form over. hopefully gets cleared soon! good luck!
