      Hope it isn’t considered spam, but here’s a copy / paste from my Form 4 Individual post. TL;DR Contact your congressman and they might just be able to speed it up for you, I think they did for me!

      My apologies for not having all the exact dates…

      Pending: 12/13/17

      Pending FBI background: Sometime mid 2018

      Contacted congressman: 08/23/18

      Response from congressman: 08/29/18

      Sent forms to congressman: 09/01/18

      Response from congressman with FBI letter indicating completion of BG check and encouraging me to inform the ATF of this: 09/10/18 (letter reported the check was completed 09/07)

      I then called the ATF yesterday and spoke to Rachel, was told pending background check. I asked to speak to someone regarding the FBI and my congressman encouraging me to inform the ATF that it is done. She transferred me to the examiner, and I got a voicemail. Left a message regarding the aforementioned information.

      Called today, and…

      Approved: 09/10/18

      Standardized wait: 272 days / 8 months, 29 days

      State: AZ

      I am so stoked. God Bless America! Don’t give up hope you long timers and reach out to your reps. Also, for what it’s worth, I had a drug charge from when I was 18 and had my rights restored, so there was actually a legitimate reason to delay it, but I am technically no longer a felon and have all my rights back. I am very pleased to see this right not denied due to paperwork / records issues. Not sure if it helped, but I submitted the app with the set aside and firearms rights restoration paperwork from the court, as well as a copy of my CCW permit approval letter. I’ve got a few Form 1s pending, one of which is in FBI land as well, so hopefully this moves along for those now too…

      Now I’m just eagerly awaiting that call from the dealer!! Thanks everyone.

      im in 8.5 months since check was cashed. It’s a bit excessive, and every time I have called its the same “pending FBI background check”. How long does it take them to punch a few keys into a computer?

      I submitted my paperwork (Form 4 Trust, myself as the only RP) October 2017. Went pending shortly thereafter, then I was told pending background check for what seemed like months. This past Saturday, I finally received a text from my dealer telling me that my tax stamp was in and everything was approved. I picked-up my SilencerCo Salvo 12 Saturday afternoon, almost 12 months since I paid for it.

      My background probably took a little longer because I have a felony conviction from 2001. I had all my rights restored last year without any issues, and now own quite a few firearms and also have a valid concealed carry permit, plus my shiny new suppressor. In addition, I was approved for a Curio & Relics FFL while my suppressor was still pending background check. I say this not to brag – not at all – but to offer some hope for the folks out here who think that they may be screwed because of a felony or misdemeanor. Of course, the usual caveat applies – the laws in your state may vary, up to and including a permanent bar on owning firearms. Virginia permits civil and firearms rights restoration provided you meet the legal requirements for restoration.

      So, 11 months of waiting and many months of “pending background check,” but to answer the OPs original question, yes, it finally was approved.

      3 person Trust

      Received Stamp on 3/12/18

      This is where is gets funny.
      Purchased SBR on 9/3/17
      Check cashed on 10/3/17
      Received letter on 9/15/18 saying i was disapproved.
      “Your NFA application has been disapproved by ATF based on the FBI reporting a final status of “open” on the required background check after 88 days and have not received information back on final disposition of potentially prohibiting information”
      I am at loss on this one. I did contact ATF and the person i talked to can’t tell me why i can have one approved and the other disapproved.

        You have three responsible persons listed on your trust. It is possible that one of them might have a rap sheet which shows an arrest, but no final disposition, or they might have fingerprints on file in a state for another reason, such as applying for a CCW. Almost all entries in CJIS or state indexes are based on fingerprint submissions. If a state has a set of prints in their index which matches one of your RPs, but the reason why the prints are there is not clear, then this will cause a delay as they search for answers. Also, incomplete military history information, immigration status etc,. will cause a delay. If they can’t get the requested information and complete the file in 3 months, it is closed.

      At this point I knew I had an issue on my hands. When I learned I was stuck in “Pending FBI” status, I sent the following letter to my examiner:

      I followed this letter up with a phone call. When I spoke to the examiner, they told me to email them the information concerning my UPIN since there is not a box for this information on the Form 1 or Form 4. She did mention there may be a place to put your UPIN on the fingerprint card? I don’t recall seeing this box as I used the SilencerShop Kiosk. Has anyone seen a box for the UPIN on the fingerprint card?

      In another followup email the examiner confirmed that the information was sent to the FBI and to check back with them in a couple of weeks if I hadn’t heard from them in that period of time.

      My check was cashed on may 18th 2018. In may I ended up getting arrested for something stupid and got 2 counts disorderly conduct 2nd degree. A class B misdemeanor. Will having a charge on me after my check cashed date effect the wait time? Or will a charge that low on the misdemeanor scale even matter? I’ve been wondering about this since it happened, the ATF states it’s still in pending and even specifically asking them if it’s in FBI review, they tell me no.

        It will very likely cause a delay in your NICS check, but since its not a felony, then it probably won’t be denied.

      How can you find out if you’re form 4 individual is pending FBI background? Is there a way to see what stages your application is in? Or do you simply call? I’ve been waiting 169 days now and I called a week ago and said it’s pending.

        Hi Jacob – you just call. I was told pending initially but that changed to waiting for background check eventually, but it was much faster than 169 days. I guess you could ask specifically if it’s just pending or pending background check when you call.

      Checked back with representative staffer that is handling my stuff and basically said he couldn’t do anything to check on his inquiries status because the fbi is a law enforcement agency.

      I just called in to check today and got my approval for two items. I had been “pending FBI background check” for a long time, and I have a checkered past as well so I’m sure that helped stretch out the wait. The agent I spoke with today informed me that the FBI is dealing with a couple month backlog.
      312 days from check cashed to approval.

      Mail it in and forget about it.

      Well I’m glad to see I’m not the only one in this situation. Called in August about my form 4 and was told it was Pending FBI Background Check. Going to call again on Monday and see where things are at. Do I ask to speak to my examiner, if nothing has changed?

      My checked cashed 7/27/2017 I counted 444 days of waiting so far and still waiting on the background check. But I did speak with my examiner and she said they are just waiting on one thing and then i should be approved. Fingers crossed!

      187 days in on a form 4 2 rp’s called today still pending and according to the rep hasn’t even been sent to the FBI yet, smh. What is the protocol now with the introduction of the fbi part? Is it check cashed, assigned to examiner, then to the fbi then approved or fbi first then assigned to examiner then approved?

      Honestly, I think the “pending FBI BC” is just something they say. Im not arguing that it does not go to the FBI bc it does, I’m arguing that the person answering the phone calls does not have a way of confirming “FBI or not FBI land” yet. Ive had two approvals back approved with “pending and has not gone to FBI yet” responses, with just days of being approved with stamp on the way. So two things are happening here, either the FBI approval/disapproval is done in lightning speed, and or the saying “pending FBI blackhole” is a farce they just tell us. Who knows, were all guessing their operation and some are straight up certain.

      Called every Monday starting in August. Every time was told “pending” and then hit “FBI Backround Check” on 17SEP18. I freaked out hearing all the horror stories from this status. Having a pending assignment as AD military to another state had me pretty nervous as well. I’m leaving town all of next week so I thought I would call and check today. Imagine my relief hearing “approved” this morning. There’s hope for those in FBI BGC that it won’t take as long as commonly associated with this status. Good luck all.

      Still have a form 1 with same cashed and fbi background date that is still pending a fbi check. When I learned of this, I emailed my examiner directly informing her of my recent approvals. She emailed back within 10 minutes stating she had emailed the person responsible for my background at the FBI informing them of the same. Hopefully this will help push the Form 1 over the finish line.
