      I also received the “Pending FBI Background check” comment when I checked the status of my Form 4 Individual for a Surefire SOCOM 762RC2 with a check cash date on 3 April 2017.

      I called a few days before Thanksgiving and was informed that I was Pending FBI Background. I followed up with calls on Jan 16th, Feb 8th and March 5th. During the March 5th call, I asked to speak to a supervisor. My call was passed to Jessica. I asked about the FBI background and asked her if there were any issues. She responded that my information only went to the FBI for the check the first week in February. She also stated that there was a person with the same DOB that had a criminal record, but no name match or ssn match… I told her that I knew that because I was looking at my NCIC/III (20 year GS1811 with a TS/SCI). The NCIC FPC shows that person isn’t me. She stated that I would be delayed for any firearms purchase. I replied that she is incorrect, and that I had just purchased a Glock 19X and received a proceed in less time than it took to fill out the paperwork (I live in PA and PA State Police does the background check)… I listened to the phone call to PICS and the background check was not sent to an operator.

      In any event, the individuals answering the phones at NFA Branch are stating that persons are pending FBI Background… which is factually correct…but does not mean that the information has been transmitted to CJIS for a NICS check. It is the case of asking the right question to get the right answer. I have two other cans in NFA jail and for future calls when I am told that it is pending FBI background, I am going to ask when the information was submitted to CJIS.

      Back to the SOCOM…I explained that the Form 4 for the SOCOM 762 was submitted at the same time as a Form 4 for a AAC TiRant 45 (which was approved in October) and were mailed in the same envelope. Jessica stated that they should have been processed on the same NICS proceed and approved the SOCOM that day.

        Just got my stamp today, after being in FBI limbo since August 2017. Took me 579 days total from Date of Purchase (08/16) to Stamp in Hand. Form 4 – Paper copy – Trust. No one on trust has any priors, no reason for it to be flagged, just “WTF”. Guess they just got tired of me calling and emailing. Oh yeah, if you have been calling FBI NICS to track your NFA item there and you got the “We are to busy to answer” message, it was because I was the one tying up the one phone line they have there.

        I’m at 345 days, but I was told one of us on the Trust was denied. The operator also told me that FBI waits 88 days for a background check before simply denying and sending this back. His info came back “incomplete” or “inconclusive”, I for get which at this moment, but he never got any information from FBI until the letter 2 days ago. Complete and utter BS. How can they say it is incomplete, if they didn’t do their job?

        The only thing I can figure it maybe since the form was received in April ’17, and his court stuff (misdemeanor DUI) didn’t get finalized until slightly after, the questionnaire may look different on that conviction question.

        So…..I have to wait for him to correct things, then send it up again, and wait another 8-4000 months for them to do exactly the same process.

        Does anyone know if I get the first $200 returned to me? Am I just out that money, and paying double? Should I send a correction up for the suppressor app that was received this year in May?

      Awe geez… just read the bit on Q clearances. I held one and currently have one one that is not active as I went back to to private sector. Even had HRP on top of the Q.

      I’ve had people tell me that slows checks for for firearms, but I’ve never seen it. My checks usually are approved very quickly. I was wondering if it would affect my Form 4 that was just submitted. Guess I’ll find out.

      I called the atf yesterday with full expectations of hearing pending FBI background check an was extremely pleased to here approved on April 8th. I can honestly say this has been the longest test of patience I have ever had to endure. I purchased a mack brothers 3.0 Varminter thru Dakota silencer at a gun show on November 14,2016 and went pending on November 28,2016 now this is where things got interesting I went pending FBI background check on i believe it was around the 26th of November 2017 on a form 4 trust I have to admit in 1996 I was arrested for a dui an possesion of a little marijuna since then i have never had a blemish on my record i guess what I’m saying is hang in there i had a 510 day wait to here that glorius phrase approved on date when you here that alone the shear joy it brings will change the outlook of your day!! I was told they now have 30 days to send the paperwork in they being the atf an then I get my transfer e-mail an a little titanium in the mail can’t wait an can’t believe this is almost over! In closing would I do it again I will let you know after I have been to the range.👍

      Just got off the phone with the NFA branch. My F4 individual was approved on 5/14/18. It has been pending FBI since 12/14/17. With the initial pending date being 7/31/17. All in all including the date of initial purchase it has been 426 days.

      Ok. So, I’ve been reading a lot of forums in reference to “Pending FBI Background Check”. Many people state that the normal process for the BATFE is to just run a NICS check and approve your stamp, unless something comes up or you are randomly selected for a ‘personal’ FBI check where an actual agent performs a background check on you.
      Let preface this with I have been in law enforcement for over 21 years and have some knowledge on how background and criminal histories work. Let me tell you what I know:
      1) Probably around 10-15 years ago, the way information like charges were added to your criminal history changed. It used to be that charges were added simply by entering you name, DOB and SSN and then the charge. Now that is no longer the case. In an attempt to cut down on the errors created when someone who was arrested gave the wrong name, DOB and SSN and the advancement in technology like the Livescan system of fingerprinting, the FBI now uses finger prints to enter charges into the NCIC/CJIS system. No prints, then nothing is added to your criminal history.
      2) I submit my prints every two years for certification that allows me to run criminal histories. I know that I have to send in two fingerprint cards every time. The FBI scans those prints and compares them to every set on file. A real background check is done by scanning your prints. Officers can still run you my name, DOB, SSN and DL Number, but nothing is added to your criminal history without prints. Most often, now criminal prints are done on a system at the detention center when you are booked in and the charge added to your record.
      3) The BATFE does not simply run a NICS check on most people and approve their ATF forms. All fingerprint cards are sent to the FBI for a background check. When that is completed, the results are returned to the BATFE and you form is either approved or denied. Again, I could be wrong, but that is what my contacts with BATFE tell me.
      4) Traffic Offenses, like DUI, reckless driving, etc., do not normally appear on you criminal history. If you received a ticket, then the offense is not on your criminal history, unless you were arrested and taken to jail. Even, then traffic offenses don’t appear on you criminal history. I’ve never seen a DUI, reckless driving of anything like that on a criminal history. Now if you commit a serious traffic offense and are indicted on a felony, that will appear.

      So, from what I have learned over the years and my contacts with the BATFE, everyone applying for a tax stamp is subject to the fingerprint based “FBI background check”. Pending FBI background check is the normal progression of either approval or disapproval, not simply because you were randomly selected or something popped up on the NICS check.

        Ron I think things are different geographically. I also have been in LE for 27 years now. In Michigan, DUI’s or OWI’s as we call them are a criminal offense. You are arrested, you go to jail, and it appears on your criminal history. So I believe what may get you “flagged” in one state, might not in another. I don’t know what the answer here is but it is ridiculous for some to get approved within a few months and others to have to wait 3-400+ days.

      Called ATF the beginning of March 2018 and they said I was “pending FBI background check”.
      Approved 5/19/18.
      About 3 months in FBI background check land..
      Now waiting on my stamp…

      I also contacted my state representatives and filed a congressional inquiry on the FBI. Not sure if this helped, but I definitely spoke my mind for everyone going through this rediculous process. I encourage everyone else to do the same.

      I called today and was told I was in the “FBI Background Check” zone. The first 3 stamps I received had this part of the process involved. What it meant, in my case, was the wait was in it’s last part of the process. It seems that this time frame is drastically different for different people, but this has been a good thing in my cases. I believe everyone goes through this and only the ones that check their status while it’s happening find out they are going through it. For most, the check is quick and they never know.

      Anyways, I get excited at this point and not discouraged. Sorry to hear about so many people being stuck in this check and I certainly hope you guys get finished with it and I get through quickly again. Good Luck!

      The FBI Background Check Myth-

      I posted this a few days ago, but today I called the ATF and they confirmed it. EVERYONE goes to the FBI background check. The NICS and the FBI Background check are the SAME THING. If you are stuck in it, that sucks. It’s not a different process. People who don’t get delayed in it, have a much smaller window to call and find out they were in it at all. Every form goes to the FBI for the same check. The ATF told me “Some people call it the NICS, but it’s just another name for the FBI Background Check. Some forms process immediately and some take days, weeks, or months. There is a backlog at the FBI”.

      If you find out this is your status, it doesn’t automatically mean you are going to be stuck in there forever. Especially, if you check your status often and can call during the window of time it’s processing at the FBI. THere is hope.

        Every time I call the receptionist just says it is pending. When it gets to the Fbi part will it say Fbi instead of pending or do I have to ask for more details. My check cash date is 12/4/17

          When your form is sent for the check, they will tell you it is at the FBI for a background check. It wouldn’t hurt to ask, but they do see it as a different status than “pending” in your file. In my experience, they will offer that information without being asked.

      Spoke to the examiner assigned to my form 1 today. Here are the details of my submission

      Corporate entity with 4 responsible persons
      Check cashed date: 5/19/2017
      Background check/fingerprints submitted to the FBI March 2018

      Examiner tells me that the FBI checks are currently taking ~5 months to complete so I’m looking at a August/September 2018 projected approval date. 15 to 16 months for the check cashed date!

      My first Form 1 only took 23 days for approval, granted it was an Pre 41F E-File Form 1 but still.

      Nope, the according to the ATF examiner it’s currently taking up to 5 months to complete all background checks.

      check cashed 11/17/17, called a few times told pending. A month ago was told awaiting approval…. Thought that was good news. Called today and was told waiting background check approval. I asked how long can this take and agent said theres no telling because a different agency does it (fbi). Can someone tell me once fbi background check starts how long till approval? I understand it will be different with each case.

      Was told first part of May my Form 4 paper was pending FBI background check.
      Every 2 weeks I called an got the same answer. Was out of town for Medical and came home to Approval dated 22 June 2018.

      269 days but worth it. Keep up your spirits it does happen.

      This was my 1st can And was slightly over the 12 month average. I would do it all over again

      I am running out of people to talk to on my individual Form 4 approval for 2 suppressors submitted in February 2017. ATF cashed the $400 on 2-25-2017. The Applications were returned to my dealer because we had apparently prepared the old 2 part form and now had to submit the Cleo portion. We were told if returned within 30 days, I would not lose my place in line. Well not trusting the possible issues with a partially completed 3 part Form 4, I completed 2 new entire Form 4 documents complete with new finger print cards, photos and law enforcement signature within 2 weeks. In October and November I was told the matter was “Pending”. By the end of 2017 it was “…in to the FBI for a background check.”

      Yes I have had 2 misdemeanors over 10 years ago. These have had no effect on any prior NFA applications. I have 6 tax stamps since the occurrence of those events and absolutely nothing (not even a traffic ticket) has occurred since. I have had 2 DoD Security Clearances, a Class III dealer’s license and FFL Currently have a CCW, continue to purchase firearms with immediate approval have professional licenses in 2 States. Not to mention I run criminal background checks (within minutes) on others every week. Hence, as to ATF/FBI this reduces to what is your major malfunction.

      This “FBI Background Delayed” status has persisted and I contacted my congressman’s office. Over several weeks they received the same status response from the ATF Liaison. Then contacted my sheriff’s department that signed off on the Form 4 Applications (they tend to do a background check before they sign those) to obtain a real ATF agent speak with. After we spoke, he e-mailed an inquiry on the status. We, off course, get the same message – “FBI Background Delayed”.

      So it has now been 16 months since the government has been paid, but no result. If you or I did that we would find ourselves in Court. I have even invited them to simply decline the application so I can recoup some of my money. They are apparently incapable of even doing that. So after all this, DOES ANYONE KNOW A CONTACT # FOR A LIVING, BREATHING FBI REPRESENTATIVE TO FIND OUT WITH WHAT THEY ARE HAVING AN ISSUE ?

        I just spoke with my nfa dealer and he said people who get a delay on their nics and get stuck there should fill out a UPIN request form to resubmit. After 88 days of waiting they will deny it as insufficient data. But you have been waiting longer than that it seems. How long has it been since they said the fbi status last?

      Well it is official, it is snowing in hell. Dealer called this afternoon and informed he now had permission to transfer the 2 new cans to me. Only took from February 2017 to now with about 4 months in “FBI Background – Delayed” limbo.

      AAC Tirant 45M on a form4 trust is in the FBI background check. Check was cashed 11/17/17.

      Last week I purchased an HK USC. FBI background check took 10 minutes. Just sayin.

      A dui will not disqualify you from getting an nfa item 😂😂 whoever told you that was a dummy. If you can buy a gun in your local ffl you can get any nfa item period

      Yup I was told I was delayed and am pending fbi background check. I’m assuming everyone that get lending fbi background check and ah e been waiting for a while got delayed! I went pending feb 5th 2018 on my can do who knows when I’ll get approved. I have a dui on my records but that didn’t stop me from getting my stamp for my sbr a year ago, amd I have my concealed carry permit for Wyoming so I dunno what’s going on. Hurry up and wait k guess! I was expecting it to take a year so wel see

      So we just sit here and put up with this bullshit and congratulate each other on allowing the ATF/ FBI to screw us like this? Is there no way to get involved to fix whatever the damn problem is? There has got to be a way that some odd 80 million firearms owners/ enthusiasts can put pressure on these agencies. This is a serious question, not a rant. What can we do to get started? Electing new officials obviously does nothing because they’re doing nothing for us.

        What’s really bullshit is that us as a country have given our government so much power, that they get to decide weather or not can have mufflers for our guns! The fact that we have to pay them a good amount of money to ask for permission to own a firearm muffler, and they can take anywhere from 6 mo-to 2+ years to get us an answer is complete an utter chicken shit. I’m with you we have got to do something but getting everyone else on the same page is honestly impossible. Due to the fact that everyone is afraid of the government. Because they have too much power that we as a people have allowed them to take! Rant complete.
