Well, I was convicted of a DUI back in the early ’90’s does that mean I’m screwed?

No that does NOT mean you’re screwed. Misdemeanor DUI is not a conviction where you incur a « firearms disability » that’s the legal definition of not being able to own. You should be fine. Just get ready and prepare yourself that you’d is going to be LONG wait cause they’ll have to verify it was t felony DUI.

No you’re not screwed. If you can own/purchase a firearm, you can own/purchase a suppressor. Just more hoops to hurdle.

Silencershop is screwing people.. there’s no reason the check cashing times should take that long, if you send you own form they cash it in like a week

I’m betting it was an error or the NFA side and not Silencershop. I mailed mine in on July 2nd and the check didn’t get cashed until Aug. 24th.

Its just something to say to instead of “PENDING”. They’re behind, so they throw it on another agency. My girls aunt used to work for the FBI in Clarksburgh WV, she called for me Jan. 26th…nothing. She said it takes them like 24HRS at most to run ATF fingerprint cards…hit or no hit. Then another 3-5 days to mail back. I have 5 form 4’s that have been “Pending FBI background check” since Nov. 21st, 2017. Check cashed dates for all June 9th, 2017. Its non-sense, just something new to tell us.

Over the past 2 months I’ve called a few times to check the status of my April 2017 submission. Each time I get “pending FBI background check”

The confusing part to me is… If I’m really waiting on an FBI background check, why didn’t that check last this long on submissions I did before, and after? What’s special about “this” submission?

The answer, I believe, comes from this reddit post:

Talked to an agent today about FBI check times from NFA

“I called to check in on a can again today. About an hour later an ATF agent called back. Apparently they get notified for some of the longer waits and she decided to call and let me know what was going on. I bought a SICO omega 9k and it went pending august 16 of 2016. I don’t know if it simply sat in the wrong stack or what but it took forever to clear. I had another can from the same SOT that went pending in November of 2016 and came back this summer. The 9k went from pending to at the FBI for background check in the early part of October.

The agent told me today that a certain number of background checks are manually reviewed even if they meet all the parameters of being accepted. I own many guns have no disqualifying records and have held clearances through the DOD. The FBI is required to clear firearms background checks within 3 days or you are able to take your item home so manual checks are prioritized for the firearms. I was told that your NFA item does not fall under that same criteria and there is no law requiring them to attend to it within any time frame. She told me that firearms sales and inquiries have been at record highs and that there has been a back up since august and they had just cleared mid September.

I thought the barcode stuff was looking promising and we would see faster times but if the FBI becomes a hurdle and there is no requirement that they speed things along we could see a new bottle neck there.”

If the above comment is true(which seems to match the other dudes thoughts that posted previous), then I guess I was simply “unlucky” and this submission was chosen as a random “full manual background check”. Because the FBI is so far behind on these checks, I’m basically stuck waiting for it to go through, even though it’s forgone conclusion that my stamp will be approved.

I suspect many of the form 4 trust and individual folks that have been waiting “longer than the normal wait” are in the same boat.

So, for some, the 6-8 month wait is what you’ll see. But, if you are unlucky and get randomly pulled for a “manual” FBI review, and are told multiple times that you’re still “pending FBI background check”, well, then you’re screwed.

So what prevents a person from passing a back ground check?
I pass all the time buying guns, hold a current cc permit for my state. I see on here people are worried for dui, stealing from Walmart in high school got arrested did community service and payed a fine, misdemeanors not involving weapons or domestic violence, minor in possession and etc..
So what makes this check so complicated or different from my others?
I gave my photos and finger prints to receive my weapons permit for a background check which took the sheriff a month to complete. 3rd time I have renewed for it.

The ONLY things that prevent a passing of the NICS and subsequent background check are felony convictions and Lautenberg Act related misdemeanor. Also, if you’re under the preview of a required « financial fiduciary » from either VA or Sociak Securty or a COURT ORDERED psychiatry in hospital patient then you might
Not pass. A fugitive from justice with a felony warrant either state or federal will not pass. A misdemeanor unresolved warrant is a possible one if it could
        Not be resolved.
Those are the real reasons people fail background checks.

Not doing the background check is a de facto block.

Here is an interesting thought for everyone to ponder about our FBI background checks for our NFA items. Do any of you find it ironic that the public at-large after the Florida school shooting are now calling for stricter FBI and mental health screening and other type of background checks for buying an AR15 or an AR10 then they are for us buying NFA items? I find that interesting. The public in the US is generally brain dead.
Now we all in 100% agreement that NONE of this should ever be required to buy anything. But this idea, at least in general in the public’s view, that we should have « strict gun control in America » is hilarious to me when we consider they are now wanting more restrictions on buying a semi-auto type weapon then they are the real full-auto counterparts. That’s hysterical to me!!!!!!!

As a side note. The value of my AR’s and my other full auto toys (I have two of those) are fixing to skyrocket! I am NOT being insensitive to the school shooting. I am a licensed peace officer and also a father of four children. Just being optimistic about the capitalization of the firearm economics.

My wife brought up this morning that maybe we should at least discuss and consider implementing the NFA rules on all AR and AK like firearms. She does not believe we should ban them, simply apply the NFA rules to them.

      Scary………

I just got the call from the dealer that my approval is in. Purchased 2/15/17 check cashed 2/20/17. I called a few times over the last 2 months and was given the “background check” status. I have another one purchased in May and check cashed in June awaiting approval. I hope the first background check speeds up the second.

I have one in FBI check now. It’s been 13 months and rolling. Got approved for my first one in Nov. Same exact Form 4Trust. I found that my State Senator’s web site has a form to address problems with goverment agencys. We can use suppressors for hunting here in Ohio. So I filled out the form. Hey it’s worth a shot. If you have a pro gun Senator why don’t we fill out these form and bring this up? Flood thier inboxs. I hope more Ohioians will do this. I contacted Senator Rob Portman. Left my info but haven’t heard back. Sooooo?

I find it hilarious that my DOE Q clearance and DOD top secret clearance both took 4-8 weeks to get approved, but putting a stock on my MPX or getting a suppressor will probably take a year. The background checks on those were quite dense and all encompassing. Heck I even had to get a psychological evaluation for one of them because of caveats of stuff I worked around and would see. All comes down to the government motto we would say at work, “hide and seek for a grand a week.” haha. Good luck fellas.

JW….and the interesting part is that since you’ve got a TS-SCI and the Q clearance means that every five years you’re going to get a redo. And guess what??? That redo will hit on the NFRTR where all NFA items are listed. So you’ll now be answering to extra questions every five years on your SSBI on why you have NFA items. Not joking. They’ve Sked me several times!!!!

Both my 1 and 4 were cashed on march 26th. I am in the same boat. They have been awaiting FBI check for months. I have both a CCW license as well as a background clearance for burglar alarm installation.

Called today on my 6/2/17 check cashed, was told “pending” and I asked if it was with an examiner or FBI and she (Ariel) told me its waiting on background check. So looks like I’m in the same boat now. I don’t know when it was started though, merp

Don’t understand the need to perform multiple background checks on the same person if they are sending in more than 1 application? This seems like a waste of everyones time, money and resources. If you send in 3 Form 1 applications together, perform one FBI background check and done. I realize this is the gov we’re talking about.

When you asked about your status did they tell you waiting on FBI or did you have to ask further? I’ve had them say waiting on background check once, and now its pending and waiting for an examiner. Wish I knew what was actually going on.

Before 2017 it was just “Pending” now its “pending FBI Background check”. We’ll never truly know what’s really going on…all I know is they are quick to pocket the 200.00 & after that there is no urgency or logical protocol or pattern of approvals on their end…approvals scattered all over the place…Junes before Januarys, Augusts before Junes. Like my brother said…just mail it in, try like hell to forget about it & be pleasantly surprised when the dealer calls to pick them up

I agree with you about FBI crap.I think it’s just something new to keep people appeased, no different than pending or with an Examiner.
